Our Terms & Conditions

These Terms & Conditions (“Terms”) govern the booking and provision of photo booth and photo experience services by Captured It (“we”, “us”, “our”) to the client (“you”, “your”). By submitting a booking enquiry, paying a deposit, or confirming a booking with Captured It, you agree to be bound by these Terms.

1. Bookings & Deposits

  • A booking is only confirmed once a non-refundable deposit of 40% of the total package price has been received, and a booking confirmation has been issued by us in writing (including by email).

  • Dates are held provisionally for up to 7 days following an enquiry. After this period, the date may be released to other enquiring clients without notice.

  • The remaining balance (60% of the total package price) is due no later than 30 days before your event date.

  • If the remaining balance is not received by the due date, we reserve the right to treat the booking as cancelled by you, in which case the cancellation terms in Section 2 apply.

  • All prices are quoted in GBP (£) and are inclusive of VAT where applicable.

2. Cancellations & Postponements

  • The deposit paid to secure your booking is strictly non-refundable under any circumstances, including but not limited to changes of mind, change of venue, or cancellation of the event.

  • If you wish to cancel your booking, you must notify us in writing as soon as possible. Cancellation does not entitle you to a refund of any deposit or other sums already paid.

  • If you cancel within 30 days of your event date, the full remaining balance becomes immediately due and payable, in addition to the non-refundable deposit.

  • Postponements are accommodated wherever possible, subject to the availability of your chosen date. We will use reasonable efforts to transfer your existing deposit and any payments made to the new date at no additional charge, provided we are notified in writing at least 14 days before the original event date.

  • We reserve the right to cancel a booking in exceptional circumstances (including illness, equipment failure beyond our control, or events outside our reasonable control). In such cases, we will offer an alternative date where possible or a full refund of all monies paid.

3. Event Day Requirements

  • You are responsible for providing adequate space (minimum 3m x 3m), a stable and accessible power supply within 5 metres of the agreed setup location, and safe, reasonable access to the venue for setup and breakdown.

  • Setup typically requires 60–90 minutes before the agreed start time and breakdown requires up to 60 minutes after the agreed end time. These times are in addition to, and not counted within, your booked hire period.

  • Any delay to setup caused by venue access restrictions, late room availability, or similar circumstances outside our control may result in a reduced operating window, for which we accept no liability.

  • Travel within 30 miles of our base location is included in your package price. Travel beyond 30 miles is charged at 45p per mile, calculated as a round trip, and will be confirmed and agreed in writing prior to your event.

  • Overrun beyond the agreed hire period may be accommodated at our discretion and will be charged at our standard hourly overrun rate, payable on the day.

4. Use of Equipment

  • Our booth, lighting, props, and all associated equipment remain the property of Captured It at all times.

  • Our equipment must be operated only by our trained staff. Guests and clients must not attempt to move, dismantle, or repair any equipment.

  • You agree to take reasonable steps to ensure guests use the booth and props responsibly and do not cause deliberate damage.

  • You will be liable for the full cost of repair or replacement of any equipment that is damaged, lost, or stolen as a result of misuse, negligence, or deliberate action by you or your guests during the event.

  • We carry our own public liability insurance and reserve the right to refuse or suspend service if we reasonably believe equipment, staff, or guest safety is at risk.

5. Liability

  • We will take all reasonable care in the provision of our services. However, we accept no liability for any indirect or consequential loss, including loss of enjoyment, arising from circumstances outside our reasonable control.

  • In the unlikely event of equipment failure during your event, we will use reasonable efforts to resolve the issue promptly, including the use of backup equipment where available. Where a fault significantly reduces your operating time through no fault of your own, a partial refund proportionate to the lost time may be offered at our discretion.

  • We are not liable for any injury, loss, or damage to persons or property arising from misuse of the equipment by guests, except where caused by our negligence.

  • Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, or for any other liability that cannot be excluded or limited under applicable law.

6. Photo & Image Usage

  • Unless you notify us otherwise in writing prior to your event, you grant Captured It a non-exclusive, royalty-free licence to use photographs and footage captured during your event for marketing and promotional purposes, including on our website, social media channels, and printed materials.

  • We will never use images in a way that is misleading or that disparages you or your guests, and we will act reasonably if you or any guest requests that a specific image not be used.

  • All copyright in images captured during your event remains with Captured It. You and your guests are granted a personal, non-commercial licence to download, print, and share images for personal use.

  • If you would prefer that your images are not used for any marketing purposes, please notify us in writing at the time of booking and we will note this on your file accordingly.

7. Guest Conduct

  • Guests using the booth do so at their own risk. We reserve the right to refuse service to any guest behaving in a manner that is unsafe, abusive, or likely to cause damage to equipment.

  • Alcohol consumption is common at the events we attend; however, we reserve the right to pause or stop the booth service if guest behaviour becomes a safety concern for guests, staff, or equipment.

8. Payments

  • We accept payment via bank transfer, debit/credit card (via Stripe), and PayPal.

  • All sums due under these Terms must be paid in full and on time. We reserve the right to charge interest on overdue sums at a reasonable commercial rate.

  • We reserve the right to suspend or withdraw our services where payment terms are not met, without liability to you.

9. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to extreme weather, fire, flood, pandemic, governmental restrictions, strikes, or failure of public utilities. In such circumstances, we will work with you in good faith to reschedule your booking where possible.

10. General

  • These Terms constitute the entire agreement between you and Captured It in relation to your booking and supersede any prior discussions, representations, or agreements, whether written or verbal.

  • If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

  • We reserve the right to update these Terms from time to time. The Terms in force at the time of your booking confirmation will apply to that booking.

  • These Terms are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

  • Billing details necessary to process deposits and balances

  • Payments are processed securely by Stripe and PayPal. We do not store your full card details on our own systems — these are handled directly by our payment processors in accordance with their own privacy and security standards.

c) Marketing Information

  • If you opt in to receive offers, newsletters, or updates, we collect your name and email address and store this via our email marketing platform (Mailchimp or similar).

  • You may unsubscribe from marketing communications at any time using the link provided in every email we send, or by contacting us directly.

d) Website Usage Information

  • We use Google Analytics (or a similar analytics service) to understand how visitors use our website, including pages visited, time on site, and referral source.

  • This is collected via cookies and similar tracking technologies. Where required, we will request your consent to non-essential cookies via a cookie banner on our website.

  • Analytics data is typically aggregated and anonymised, but may in some cases be linked to an individual browsing session.

e) Event Photography & Footage

  • During your event, our photo booth captures images, GIFs, and short video clips of you and your guests.

  • These images may include the faces and likenesses of guests attending your event, in addition to you as the client.

  • Where you and your guests use the booth voluntarily, this constitutes your consent to having your image captured for the purposes described in Section 4 below.

3. Legal Basis for Processing

  • Contract: to fulfil our booking agreement with you, including taking payments and delivering our services.

  • Consent: for marketing communications and non-essential cookies, which you may withdraw at any time.

  • Legitimate interests: for general business administration, fraud prevention, and improving our services.

  • Legal obligation: where we are required to retain certain records (e.g. for tax and accounting purposes).

4. How We Use Your Information

  • To respond to enquiries and manage bookings

  • To process payments, deposits, and balances

  • To deliver your booked photo experience, including providing the online digital gallery of images from your event

  • To send booking-related communications (confirmations, reminders, invoices)

  • To send marketing communications, where you have opted in

  • To analyse and improve our website and services using analytics data

5. Who We Share Your Information With

We do not sell your personal data. We may share information with the following categories of third party, solely for the purposes described in this policy:

  • Payment processors (Stripe, PayPal) — to process deposits and payments

  • Email marketing platform (Mailchimp or similar) — to manage opted-in marketing communications

  • Website hosting and analytics providers (e.g. Squarespace, Google Analytics) — to operate and improve our website

  • Enquiry and booking data is retained for as long as necessary to fulfil your booking and for a reasonable period afterwards for accounting, tax, and dispute-resolution purposes (typically up to 6 years).

  • Marketing data is retained until you unsubscribe or withdraw consent.

  • Event photographs and footage are retained in line with the retention terms set out in our Terms & Conditions.

  • Analytics data is retained in line with the relevant analytics provider's standard retention settings.

8. Your Rights

Under UK GDPR, you have the right to:

  • Access the personal data we hold about you

  • Request correction of inaccurate or incomplete data

  • Request erasure of your data, in certain circumstances

  • Object to or restrict certain processing, including marketing

  • Request a copy of your data in a portable format

  • Withdraw consent at any time where processing is based on consent

  • Lodge a complaint with the Information Commissioner's Office (ICO) at ico.org.uk if you believe your data has been mishandled
